'Idol' making up rules as it goes along

There are a few certainties about "American Idol." Simon will be booed by viewers for stating what's clearly obvious to anyone with working ears. Paula Abdul will act loopy, convincing viewers that there's something other than Coca-Cola in her red plastic glass. And of course, one or more of the "Idol" wannabes will see a scandal from his or her past surface and threaten to knock them out of the competition.

This year, two minor scandals bloomed forth even before their singers got very far in the contest. Akron Watson was disinvited from the Hollywood round for no apparent reason, leaving most to assume it's because of the marijuana bust in his past. Ashlyn Carr, memorable because Simon and crew first disinvited her to Hollywood, then called her back, apparently once confessed to dumping sugar in an ex-boyfriend's gas tank. But Akron's dismissal was quietly shoved under the rug, and Ashlyn didn't last long enough for her sugary-sweet past to become a worry.

They're hardly the first "Idol" wannabes to have run-ins with the law. Perhaps the most famous is Bo Bice, who almost won it all in 2005. The long-haired rocker was arrested twice in the four years before his competition, once for felony cocaine possession. He completed a drug program and had that charge dismissed. When The Smoking Gun dug up the charges, Fox was almost snippy about defending Bice, calling the site "salacious" and saying that Bice had been honest with the network show about his charges.

A more uncomfortable moment ensued when finalist Scott Savol turned out to have a domestic violence arrest in his past, allegedly shoving the mother of his son and breaking a telephone on her. (Telephones are made of pretty sturdy stuff, so, ouch.) Again, Fox said Savol had been honest, and he stayed on the show.

Compared to drugs and domestic violence, current "Idol" singer Antonella Barba's reported risque photos seem pretty mild. Some say she's not even the person in the racier photos, and even if she was, what's her crime? She was young and stupid and someone had a camera. Viewers can't help but remember Vanessa Williams, Miss America 1984, who had to give up her crown thanks to naughty photos, and went on to be recognized as the most talented Miss America ever.

"American Idol" producers have been ignoring Barba's photos, and that seems like a fairly sensible decision, especially considering she does not possess one of the show's strongest voices and is unlikely to go far. But there's one problem with the producers' sudden attack of logic: Frenchie Davis.

Davis was booted from "Idol" in 2003 because she'd posed for racy photos on a Web site. She was paid for her photos, while Barba (if it is Barba in the questionable pics) appears to have been just goofing around. But Davis was kicked off the show, while Barba was not. Was the fact that she accepted money for her photos the difference?

Since Davis is black and Barba white, some are calling it racism. Davis isn't among them. She doesn't think race has anything to do with it, but from interviews with her, it's clear that she does see a double standard. And she claims she was clear about her photos before going on to the show, just as Savol and Bice reportedly were about the issues in their pasts.

Davis went on to find Broadway success, and is currently singing in the musical "Rent." She's hinting that she wouldn't mind a monetary settlement from the show, saying she is owed more than an apology, which is absolutely the wrong thing to say. The ground she's standing on would look a lot more firm if she simply went forward and saying "I don't want money, I just want someone to explain the difference."

"American Idol" is a family show, no question about it. Obviously, the show producers would love it if all their contestants came to the stage fresh from feeding the hungry and building homes for Hurricane Katrina victims. But these singers are at varying stages of life -- some are wide-eyed and 16, others are married parents, aged 27 or 28.

And the show is kidding itself and its audience to pretend that the music scene that its contestants desperately want to enter is just one step away from the convent. When Bo Bice's drug arrests became public, savvy observers laughed at the idea that a guy who's been playing music in bars for years was expected to have never come in contact with drugs.

It's not that Fox should let a serial killer into its tidy little contest -- no one's asking for that. And most people don't think Barba's photos (again, assuming they are of her) are worth kicking her out over, either.

But if the show wants this Barba-Davis issue to go away, someone at Fox needs to step up and address the issue. This is very unlikely to happen, considering how secretive the show is about things such as vote totals and phone-line glitches, but here's how I'd like it to go down.

A show spokesperson should speak publicly and explain why Davis was kicked off and Barba hasn't been. Maybe hand out a chart: Domestic violence: OK, if it doesn't involve anything heavier than a phone. Drug arrests: OK, if you get treatment. Racy photos: OK, if you're not paid for them. Or make a blanket statement: If we know about your issue ahead of time, we'll take it on a case-by-case basis, but if if we're blindsided by the tabloids while you're on the show, you're going home.

Whatever their explanation is, if it rings true, viewers will know. If not, then the show has deeper problems.

ALERT! It's a TV show...and Davis asking for money pretty much shows her real wishes (not to mention what she cares about: money). Just as with most low level trials, different circumstances (or phases of the moon) result in different outcomes. Davis can move on to her apparent success and stop mooching off her previous fluke problem on the show. Be happy, quit whining, don't make someone dredge up something that is NOT good for you!
How about the difference being that Davis admitted her photos and Barba has denied that the photos are her since the beginning? However, I don't begrudge Frenchie Davis a trip to the American Idol ATM if she can get it. :D
Personally, I think the difference is that Frenchie posed for pornographic pictures (not lingerie shots, as has been claimed) for money and didn't acknowledge that until after she had become a Top 24 finalist. Antonella, on the other hand, had private photographs published of her. So while Frenchie was a knowing (and paid) model, Antonella was a victim of "friends" cashing in on her new fame. By the way, excellent article. It's nice to see you gave some real thought to the matter.

Why must you continually dredge up "garbage" about Bo Bice? Bo made mistakes in his past and he changed his life for the better. The big difference is that he was honest and up front with AI about his past. If you want a REAL story, why not write something positive about Bo Bice. You could not find a more humble, charitable, loving, honest, and Christian celebrity if you tried. Just an example: Bo had to leave the AI4 tour due to major surgery, however, he returned for their last concert which benefited the Red Cross. Then, he and his band performed at two additional concerts to help Katrina victims. On top of that, Bo donated his home to a family left homeless after Katrina. The list of charitable actions could go on and on here, but I hope you get the message! How about some objective journalism instead of such sensationalism for a change?
what's good for one should be good enough for the others! Judge them all by the same standards or quit judging period. The show is about singing talent you either have it or you don't. Make your own judgement about what people do in their own privacy that does not relate to their singing abilities! Personally they all need to go, Randy, Paula, and that Simon!!!...
If Idol always picked out clean cut people, the world would be bored! Seems these little 'scandals' are keeping people watching Idol (this IS one of the dullest seasons EVER), so the producers aren't as ignorant as some think. The ONLY difference between Frnchie and Antonella? 1 made $$$ and 1 has not (at least not that I know of.
It's OK that rules change as the show goes along. Doesn't that happen where you work??? No one owes anyone anything, it's a contest and no one is promised anything. One rule I would like to see changed is that 6 men and 6 women go into the finals. The best should be put through and the rest go home.
It is easy for a white person to say move on but for years black people have been hit with issues that you can't do this if you don't have this. But a white person w/ no talent or little talent can be given anything. It is wrong and I believe Frenchie has a case of discrimination under the guidelines of the CONSTITUTION....
I think it shows this country's issue with weight and race. Look at the differences: Antonella is a beautiful young white girl, of course AI would not be embarrassed by her photos and by America's standards they would have been by Frenchie's photos regardless of whether or not these women were paid. This is a double standard and Frenchie should take them to the bank or Antonella should have been kicked off to!

While I wouldn't quite be ready to cry "racism" I do see where a host of negative - and more likely - differences might be perceived. Is Antonella staying because she's prettier? Thinner? A better voice? What? I'm sure there will be a host of theories and explanations. I've seen the pictures; all of them. I haven't been watching AI enough to know if they are, indeed, her or not. Some, as stated publicly, certainly are of her, and that alone should be enough to disqualify her. Yes, most of us have done questionable things in our past (thank God none of my exploits have been photographed!); that's not the issue here, and one must be careful not to become obsessed with this fact. The issue is also not who posted the photos, how they became available, are the seedier ones truly of her, or any other silly, trite detail. The issue is, does a family show that purports to espouse such values allow a contestant with said questionable photos out there for all to see the continuing chance to compete? I have to say, in all fairness, my vote would be "no". AI seems to have taken a hard line with scandals in the previous seasons, why not now? The difference in action on the producers' part is clear; what isn't clear is why. The issue should be addressed and personally, I think Antonella needs to be let go. She knew (or at least should have known) these photos could come back and bite her in the a*s. Yes, she was young, yes we all do crazy things, but we all don't need to audition for a television show, the act of which will most assuredly cause any hidden dirty laundry to come to light and be aired. She should accept the consequences of her ill-conceived past actions and move on, a (hopefully) better person for having learned such a valuable lesson.
I totally agree with how FOX/A.I. should handle the situation--guidelines!! Better yet, leave things "as is", and maybe I will try out next year if I put "racy" photos on the internet, go to rehab after being charged with possession and/or distribution of drugs, kick a dog on the way to the audition and get caught on tape doing so, and lastly, who cares if I can sing or not!?! (AS long as I look good, right?)
Big difference between a friend snapping a photo that they use against you and having professional photos of you intentionally used for this purpose. We have all had that friend that turns on you for their own 15 minutes of fame. Frenchie should stop whining and move on......
I love how everyone conveniently forgets the big difference between the two situations: the fact Frenchie's pictures were done for a website that takes adult teens who look significantly younger than their age and dress them up to look even younger (i.e., a faux pedophile website where perverts can go to pretend they're looking at nude pictures of kids). It's one thing to have naked pictures of you on the Net, but it's quite another to have them looking like they were done when you were 13 whether you were or not.
Who cares about Barba's photos, she can't sing! Get her off of there! And Simon is almost always right, but the meaner he is to a contestant the more likely they are to get voted through. Go figure!
I don't think it would be such a big deal if Antonella was one of the top AI wannabe's. I think most people are making a big deal of it because she should have gone home already and she's still there. Frenchie was way more talented. AI doesn't know what to do. They are definitely making up the rules as they go.
Let's be honest. It has nothing to do with race. Or money. It is because Antonella is hot and everyone loves the pics and frenchie isn't. I think it is sad and the double standard is stupid (I didn't think Frenchie should get kicked off at the time).
Frenchie is not the one digging this out of the grave. It's her fans, critics of the show and loudmouths like Rosie O'Donnel, who think they are doing her a favor, bringing this out in th epublic. There is a difference in what Frenchie did and what happened to Antonella. Frenchie posed for a public site. Antonella's privacy was invaded by her jealous friend who was cut from the show.
Barba needs to go. The bottomless pictures of her with her little wet t-shirt in the WWII memorial is over-the-top disrespectful, never mind illegal. Frenchie's pictures weren't smart, but didn't break federal laws.
Oh, and by the way, I think I know how AI could actually make this into a talent competition vs. a popularity contest. Let the audience vote for the person they would like to see go. The person with the MOST votes would then be booted off. It's a foolproof way to make you vote on talent only.
The key difference between Barba and Davis is that Davis had a very good shot at winning it all while Barba will be gone soon. In the eyes of the show, what does it hurt to keep Barba on since she obviously helps ratings? The producers know she won't last. Frenchie had a legit chance of winning.
Okay, there's a pretty big difference in being paid to be featured on a pornographic Web site as opposed to be young and kind of dumb. The pictures I've seen of Barba appear to be pretty typical of your average sorority girl. I don't think I've come across the racier pics, but apparently they're not her anyway. Davis was paid to pose topless for a porn site. Barba was simply being young and having fun without regard for the consequences of there being cameras around. Big difference.
There's no excuse for Barba having the pictures taken, of her performing oral sex on a guy, in the first place. The girl is a very poor example, of what an Idol should represent, and has no business on the show. My immediate re-action of the girl was.. she's not there, to become a singer(and we all know it). So give her to Hefner.., whatever it takes, to get her off the show.
This is exactly the same thing I've been saying all along... And only now someone seems to agree with me and bring up the whole Frenchie Davis thing... Antonella Barba CANNOT sing, Frenchie could and does so beautifully on the broadway stage... The ONLY reason Antonella is still there is because she's white
Davis asking for money? A bit trifling, if you ask me. The fact that she was paid for the pictures DOES make a difference. And in any case, Davis got the better deal - she didn't have to stick to Idol's draconian contracts which last forever and stick it to the artist. Girlfriend is in "Rent", for crying out loud - if she hadn't been on "Idol", she'd be a head cashier at Target.
This show is racist, look who produces the show "FOX" nuff said huh? But anyway, JOHN before you comment read the whole story, there have been others who had far worse issues than photos or a minor pot charge. Every southern rocker Idol had had a CRIMINAL PAST! does that count as a reason to go? I think so. But i cant get into their heads(the Producers) but I'm not watching anymore , and the longer this goes on noone else will be either.
Treat them the same. Boot Barba the same as Frenchie was booted. Let her try and work it on on Broadway, Playboy, or whatever other venue she decides to pursue. Barba shouldn't be given any special considerations.
I just started watching American Idol this season, but was aware of the whole "Frenchie" debacle. This does seem to be a double standard on the part of the Idol producers, and Frenchie should have no problem hinting at monetary compensation. If she had stayed on the show and won, who knows the financial gain she would have gotten.
Personally - I don't care what salacious history is behind these contestants. Rock and Pop stars have always and will always have their share of bad decisions. It doesn't make them any less talented. You could say they don't deserve their stardom, or that they've "bitten the hand that feeds", but just like a certain percentage of the "non-star" people out there do "dumb" things, a similar percentage of the stars do. Stars, just like athletes, are talented people doing work with their talent. They are not pretending to stand on higher moral ground - that's our politicians (who also make their fair share of dumb decisions!). I don't know nor care why Frenchie is gone, and Antonella isn't. I know that this years competition is the weakest I've ever seen (maybe as weak as the year with Fantasia - I never liked anyone on that season either!).
American Idol is loosing a big fan base. Barba needs to go. How can you justify keeping her. What is the line in the song from WEST SIDE STORY "to be white in America" Wow.....what year was the movie out? .... and it still rings true today, and then for the producers to ignore the issue, not even address it. Amazing.
Well, Barba took some of her "racy photos" in the fountain at the WWII National Veterans Memorial. How much worse does it have to get for someone to be asked to pull out of the show?
Wasn't the site Frenchie modeled for promoting underage sluts, even though the women photographed were of age? If so, that's one difference. the second difference is that she confirmed that she posed, while the other girl denied it. Furthermore, and girl that was actually photographed has already come forward and confessed. I think Frenchie is ungrateful. She she's gotten too much opportunity out of American Idol, where she wouldn't have otherwise; yet, she continues her panhandling. AI doesn't owe her a dime.
If Barba at least had some singing talent the situation would not be so bad. Barba should have been eliminated two weeks ago and the only thing keeping her in the competition is the fact that she has developed a fan base as a result of the photos. The girl can't sing! American Idol producers need to change some rules - Vote for the person that you want off the show not the person you want to stay.

In my opinion, American idol may be losing its spark. It is for me anyway. It seemed this season, during the auditions, they were more interested in showing who did NOT make it, than showing the ones who did make it thru to Hollywood. That lost my interest. I truly believe that American Idol is fixed anyway. They have never told the public how may votes the contestants get week after week, so how do we know that its legit? Sorry Idol, but you have lost me as a viewer.
Sure, John, American Idol is just a TV show for those of us watching it at home. The stakes are a lot higher for the competitors. Davis is doing fine for herself, so I agree she doesn't have much of a case. But at the very least, AI needs to adopt a clear, consistent set of standards for their competitors; it can make the difference between a hugely profitable career and fading into obscurity.
for those of you who say that there's a difference in that Barba was 'young and dumb', why not ask yourself this: Couldn't it be possible the Frenchie was 'young and dumb' also???? I mean, she was 19 and wasn't she trying to make some money while at Howard University???!!!!! At least Davis can argue that her lapse in judment was a means to an ends..which was paying for education! I mean, sheesh, stop justifying Barba and criticizing Davis when it's the SAME THING morally! And i listened to Frenchie's interview on the radio today. She did not ask for monetary damages....she just wanted and apology and an explanation. Wouldn't you?!
While I do agree that there should be some explanation for what is and is not acceptable, I imagine that, much like in the REAL music industry, the Fox producers decide these things on a case by case basis. There's no rhyme or reason to the decisions made. If Frenchie did indeed disclose the information about the photos beforehand, she should have stayed on, since the main theme here seems to be "prior disclosure". However, I'm questioning whether or not she did mention those photographs beforehand. I recall that at the time, Fox said they weren't informed at the outset, and Frenchie didn't argue that. All of a sudden now she's holding out her hand and saying otherwise. I loved Frenchie and find her very talented, but I don't believe that Antonella's photos have anything to do with Frenchie's. Frenchie posted "professionally" and was paid for an adult site. Antonella's personal and private photos were apparently taken from her computer and posted on the web. The music industry doesn't base anything on vocal talent. If it did, 3/4 of the artists out there would be jobless. So let's not pretend that Idol is anything different. It's a popularity contest. That's it and that's all.
Antonella needs to go, it's a damn shame she's still around the simply fact is she CANNOT sing... For me AI is losing credibility with me and I'm sure with other Americans . Right now it's all about race, a fact that's glaringly obvious, because quite frankly, what's good for one should be good for the other...
Why is it when someone gets caught doing something criminal or immoral it "screams of racism". Doesn't matter what Frenchie is, what she did for money was disgusting and it got her kicked off but let's sue and claim FOX is racist because we can and that can get money. Claiming that it was injust b/c they both were found on the internet won't get a monetary settlement.
Idol is a singing contest not a contest on who has the best character or morality. I think criminal background should be a non issue as well as posing naked. I'd pose naked for money. Frenchie needed the money I would assume. Simon is well known to be a womanizer, should he be allowed to be a judge??
I say let's not have 6 and 6. Let's just have the top 12 voices go into the finals. People are in among the top 12 because of their sex and not their talent!
The real question should be how old was she when she took these pictures. If she was under 18 then everybody who has looked at these pictures, took the pictures or are in them, are guilty of some type of child pornogophy.
Personally, I think that it's ridiculous that the Barba-Davis problem has become a race issue. I'll be the first to admit that black people are consistently treated as second-class citizens in this country, or are denied the same benefits and privileges as white people. However, I think it's a little irresponsible to quickly label it a matter of black vs. white before looking into all of the possible reasons for Davis' dismissal from the show when Barba is (so far) allowed to stay. First of all, Barba, or at least camps for her, are vehemently denying that the pictures circulating are of her. Regardless of whether or not they are, it would be unfair to dismiss her from AI without first investigating to find the truth. Secondly, Davis achieved a financial gain by posing for these pictures and having them published in one capacity or another. Barba, however, is only achieving public humiliation and although the pictures are inarguably distasteful and not for young eyes, the fact that she did them as an adult and under the impression that they were not going to be publicly available should at least allow her the benefit of defending herself (if in fact they are of her). And we all know what we were taught as children -- when someone's teasing you or embarrassing you, the surefire way to get people off your back is to pretend like it doesn't bother you. For Antonella to admit defeat and be booted from the show would be a victory to whomever it was that decided to distribute the pictures and ruin this girl's probably already slightly tarnished reputation. And finally, frankly I think that the Davis camp should just simmer down about the entire debacle because it's not as if being booted from American Idol ended all opportunities for Frenchie to make it big. She's on Broadway, for cripes' sake! She's got an amazing voice , and with her obvious talent, she should be happy with the fame that AI brought her, even if it was prematurely cut off. Let's face it -- Barba, if voted off, probably wouldn't be signing any record deals in the near future. Let her have her fifteen minutes!
There is absolutely a difference between posing nude for money and having personal pictures taken...and I am tired of hearing it being a racial thing!!! Then to try and get money for having been booted off is a disgrace. Why is it that when something like this comes up and the circumstances are different it always seems like a racial act?????
Am I the only one who sees a hispanic/latina when I see Miss "Barba" that's not a White name, she's not a white girl...I'm a white girl and I don't look like that! So that ends the racism debate - right??

I feel that Davis has a valid point. If the producers are going to kick contestants off the show they should have equal standards for everyone. Whether Barba posted the photos or not still deserves some kind of explaination from the producers as to why they are or are not addressing the topic. There doesn't seem to be any set rules or guidelines. I'm still upset over the fact that Barba and her friend purposely submarined another contestant's chances at making the selection during Hollywood week by not practicing with the third contestant in the group singoffs, and at the last minute decided on a song that the two friends new and had more than likely practiced for. This left that poor third contestant bewildered and left out. It's no wonder she couldn't remember the song. I guess Barba and friend were prettier. Talk about double standards. Leave out the teaming up stuff unless the producers have some control over it and make sure that evey contestant has equal opportunity to present themselves to the best of their ability. I know this is not a perfect world, but come on. Let's make this equal for everyone concerned. I love the show, but I think the Producers need to overhaul the procedures for contestant selection.
