Imus sues CBS

Don Imus was all apologies when the fire was raining down on him for calling the Rutgers'  women's basketball team names. But he's not taking his firing sitting down, according to Fortune.com. They report that the DJ plans to sue CBS radio for the $40 million remaining on his contract.

At first, the alleged suit seems laughable. Imus messed up, he got fired, and now he wants his big paycheck for doing nothing. But nothing is that simple. A source tells Fortune that Imus' contract urged him to be "confrontational and irreverent," and that he was promised a warning before he was fired. I'm no contract lawyer, but if that, especially the last bit, is really in Imus' contract, he may have a case.

It could get really interesting from here on out, however, if the suit does come to pass. Imagine suited up lawyers trying to define "confrontational and irreverent." I would think that CBS's side of things would be that it's one thing to be irreverent about public figures, another thing to use a tasteless racial slur against college women who've never asked to be in the public eye in quite the same way.

The "warning" language, if it exists, is more interesting. Did CBS really put that in Imus' contract? Had they thought that through? If the DJ did something severe enough to rate a warning, couldn't CBS have foreseen that a public outcry akin to the Rutgers situation would erupt? High-priced lawyers on both sides must be licking their chops at the prospect of delving into the actual contract language because if it's at all as Fortune represents, there could be a million loopholes on either side of the fence. If anyone thought Imus' firing meant his name would stay out of the news for a time, stay tuned. It looks like things are just heating up.

Imus never should have been fired in the first place. He is a shock jock and was doing his job. I don't understand why everybody is so afraid of Jesse Jackson and Al Sharpton, two men who have had nothing to do since April 4, 1968. And personally, I am sick of listening to people apologize for everything they say. Unless someone is my friend, I don't expect an apology if they say something publicly that hurts my feelings. People need to get over it an move on. And don't worry, Imus will be back on satellite radio, just like Howard Stern is. At least there he can say what he wants without worrying about being fired.
I support Imus' firing. But not for saying what he did. Companies stopped advertising on his show, and when a show like that doesn't make money, it's not good business to keep him around.
I see this as double standards. No one should say any comment about another, but the rappers sure do use the "language". But all you hear from Rev Sharpton and Jackson is oh we will talk to them about it. Come on what is good for the goose is good for the gander
Don Imus made a incredibly insensitive remark, and apologized over and over. The Rutgers womens BBall team excepted his apology and that should have been it. Imus could have done alot more good for these types of causes if he was still on the air. For NBC and CBS to buckle under the pressure of one of America's biggest racist's Al Sharpton is a disgrace. As a GE stockholder MSNBC should do all of us a favor and just have a blank screen from 6 to 9am. The Susan whatever show is beyond pitiful. Wake Up.

Since Imus is off the air, there is nothing on radio or TV worth tuning in to. I hope he wins his lawsuit and laughs in their faces! CBS radio is a joke and MSNBC is not worth watching anymore...
IMUS- Sue the Hell out of those spineless bastards at CBS. This is still the United States of America and you can say any damn thing you want to. I may not agree with what you said but would fight to the death, as a lot of other Men and Women have done, to give you the right to say it.

I hope CBS Radio & MSNBC both go flat broke because they were stupid enough to cave in to Al Sharpton & Jesse Jackson. Imus made a remark that offended some people; he apologized and was suspended...that should have been enough. Chris Rock offends me every time he calls Caucasians "dumb crackers' but we have no voice. Sue the heck out of 'em, Imus and please come back soon...stronger than ever!
MSNBC's trying to replace IMUS and it's not working....hello!!!! THe first guy was bad until I saw Steph...I knew she wasn't going to make the week. Who is making the decisions over there? I pray that Imus goes back to TV because there is NOTHING on to watch!!!!! I will but or do whatever when he comes back!
It has been a couple weeks and I don't see any reports from Sharpton or Jackson on how much they accomplished in terms of cleaning up rap, but they may have been sidetracked by another crusade. In any case Imus was wrong, he apolgized to the team, remember them the ones that were hurt, and they were classy enough to accept it and move on, imagine that.
This is now equal justice for an injustice. I really think that when all the people like Howard Kurtz and others are talking about Imus and his desire for money. Why doesn't CNN and others recognize the fact that Howard Kurtz and others were regulars on the Imus show and they self-promoted their careers on the Imus show...all the time knowing that the program was a shock and joking program. Way too serious about taking a sentence out of context.
Don should absolutely file a lawsuit here. What ever happened to freedom of speech in this country?
Why were Imus' coments reacted to so drastically? Where were Jackson and Sharpton when the black woman accused those white boys of rape at Duke? There is a problem but when certain persons only react to the black being victims then it is reverses racist!!

I agree with the Imus suit if he decides to go for it. I think the comment was in bad taste but certainly not a comment to destroy his life and that of his broadcast crew. Don Imus did more good and charity work than 99.9% of the public and certainly more than those whose brought him down. I quit watching MSNBC since they fired Imus. If the powers to be think Sharpton is more relevant than the Rutgers team apology then they should pay the price in cash as well as lost audience.

I agree with an earlier quote just leave the time slot from 6:00 am until 9:00 am empty the viewing and air time would be more enjoyable. HERE IS A BETTER IDEA. Try apoligizing to Imus and maybe he might consider bailing your pathetic posteriors out of limbo.
Imus was fired because the show's sponsors pulled their advertising. It's always about the money folks. Sharpton and Jackson don't have to worry about justifying their jobs by bringing in revenue for an employer.
The Stephanie Miller show? How's that working out for you? She even has a Bernie look alike and a Rob Bartlett look alike. I could get more laughs by farting in church. This should never come to this. The loss of advertisers would have been temporary at the worst. The majors may have stepped down but by now somebody would have stepped in and at least made up a portion of what was being made. What do either MSNBC or CBS have to replace Imus advertising at this point ahhhh maybe 5% I'm guessing. It's time we grow a set and stand up against the racial card that is played. If you don't like what is said, tune in elswhere. That's the American way.

I can't wait for this lawsuit! CBS will look even more stupid than they do now. Firing Imus was an idiot's idea. Yes, he was insensitive, but apology accepted and let's move on. People forget that this is a man who lives redemption one day at a time. It's time for America to have an open dialogue about the general disrespect that has crept into all facets of life, and the double standard that exists in certain areas of entertainment. Imus is just the guy to do it with candor and honesty.
CBS/MSNBC expected Imus to be controversial when they renewed his contract this year. They got no surprises as he has not changed his tactics lately. With Imus, I got more current, clear,news & current affairs in the mornings than I did the rest of the day. I do not support his firing and furthermore I no longer watch MSNBC as there is absolutely nothing on. It is a joke! Who is this Jennifer? Quit being afraid of Jessie Jackson & Al Sharpton.. they only want another way to further themselves.
I Miss Imus in the Morning, There is nothing to watch in the Mornings now, all the other News Programs are boring and have no class. Imus's Show did more good than bad things, He is more than just a Radio Host he was very sensitive to people in need and tried to help with raising money for different charities. Al Sharpton and Jesse Jackson are useless and contribute nothing to Society.
I'm very happy that Imus is suing CBS. What gutless wonders! Imus was the best thing on morning radio or TV. After recommending MSNBC to others for years, I haven't watched it at all since Imus was dropped and have urged others to stop watching that cowardly cable network.
IMUS made a mistake and apologized. He is not a racist, becasue NO ONE and NO GROUP was safe from being poked fun at, ridicule, or of being the butt of a joke. He has turned a lot of things around (including himself) and he would have opened up a debate/discussion on racism that would have been heard by many. With all his nonsense, he sure has opened up discussions and put the sdpot light on important issues and raised money for worthwhile causes. Wouldn't his dialogue on racism have been refreshing... Or would we rather have a mean spiritied discussion led by Jesse and Al who are one-sided, racist, and NEVER apologize for the misery they cause with their ongoing hate mongering.
I am a very conservative male in my 50's that looked forward to the Imus show every morning. I did not care that Imus leaned to the left because his entire production was outstanding. We all knew that he was an entertainer and that he abused everyone equally. If Imus was really a racist why did he put Harold Ford, Jr. on his shoulders and nearly make him the first black Senator in Tennessee since reconstruction.
Mr. Paul James, of Greenwich CT has the correct view of the Don Imus' firing. It was an insensitive remark but that is what made the network profitable. I do not believe that Imus' joke reflected his true feelings. It was laughter they were reaching for with that comment. Feeding off one to the other, as they have always done. I believe Imus to be a feeling person from the inside out. This situation had nothing to do with Sharpton or Jackson. However, if they see a small puff of smoke they have the ability to fan it until there is a blaze so large it cannot be contained. I believe if they are indeed Godly men, they would do Gods work (God does not cause problems, not mettlesome, instead is a forgiving and loving God) these two men ought to walk, talk and live the words of Jesus. It bothers me that if a black man had commented about white women in a derogatory way not a single thing would have happened to him. What about the familiar joke "she dances like a white girl". White people do not stick together like the Sharpton's and Jackson's of the world. That is sad. Where is the justification in all of this. Does CBS and NBC not understand what this is going to do regarding "free speech". Now the door is open and there is a lot more of this that will happen again and again. NO MORE FREE SPEECH…………. Imus’ image is that of a tough acting person but that is just a persona. His apology should have been enough. At least he was a big enough man to say he was wrong and he was sorry for his comments. If the Rutgers team accepted his apology it should have been over. Prayerfully Imus will have a new and more supportive venue to continue his good works and entertainment for those of us who appreciated his and all the staff members humor. Where is the support for Imus? Will his followers be brave and support and follow him. I would follow him anyplace before I would Sharpton. What about you??????????????????????????????????????????????? Maybe just maybe the next time Sharpton opens his mouth and gets involved in a situation that is not his own, perhaps there will be another mouth as big as his that will take issue with Sharpton. Imus was fired because he personally attacked an identifiable, very specific target--not because he was talking about "hos" in general. I can't think of anyone, except for self-employed artists, who can say and do whatever while at work. Although rappers use the same type of language, and I do not condone (nor listen to it), it does not excuse Imus. Those rappers are created by and create the black community. They are often involved in intimate relationships with black women. What many are pointing out is that black male/female relationships are in trouble. It is not a problem that Imus can solve nor know nothing about.
Imus is in a position of power. A position he abused by smearing the reputations of a group of innocent young women. He realized his mistake and apologized, that should have been the end of it. Then 2 of the biggest racists in the country, and a corrupt media giant got involved. They did something that should be considered illegal in our "free speech" country, they tried to "silence" someone. Sue the hell out of them.
Leonard Pitts wrote an excellent column about this. His premise is that if you wanted to call Oprah or Condi "nappy..." that would have been far more tolerable than describing young college girls in this way, as the standard is different for public figures than for private citizens. Imus was a bully in this case, not just "irreverent". That is the line that was crossed. I would assume that CBS has scads of lawyers that vetted the firing and contract language before they dismissed him. If they missed the "irreverent" clause, the lawyers should be fired too! He can say whatever he wants and exercise his right to free speech, but he has no Constitutional right to be paid for these things.

It is a shame, Don Imus is an entertainer, he is not a racist. He said he was sorry he made the remarks and apologized to the people he offended and they accepted his appology. I will dearly miss listening and watching Imus. I will not intentionllay watch or listen to cbs or nbc.
I hope Imus sues them for everything they are worth. How awful must MSNBC be now? The network is largely now banned from my household. Nevertheless, I actually tried to watch some of the Stephanie Miller Show. I couldn't watch it for more than 5 minutes! Truly awful television and radio. Not funny not interesting and certainly not entertaining. NBC and CBS folded like a couple of cheap suits in the face of the extortionists Jesse Jackson and Al Sharpton. Oh and by the way, if their constituency is in fact poor, then their followers don't buy products anyway. So who cares what they think? Bring back Imus!!! Bring back Bernard!!
IMUS was, and probably still is, a troubled fellow confronting some personal demons. It would be best for him to be off the air for a few years. I have also been informed by people who worked for him that, as he became more successful he became more arrogant, more tempermental, more insensitive with his staff.
I think Imus is a loudmouthed jerk. So I didn't listen to him but if other people want to, that's their problem. The saddest thing about this is the culture of victimhood displayed by the Rutgers team. They worked hard and won a national championship, and a stupid remark from a clod reduces them to quivering tears, a response encouraged by Sharpton and Jackson. "Screw you, Imus, we're the champs and what have you won lately?" should have been their response.

,I turned on MSNBC this past Monday 7am hour to see if it could possibly be any worse than last week with the guy from Philadelphia,it was actually worse,and unbelievably within a few minutes the host Stephanie Miller used the word "Ho" in calling her own mother "an adulterous Ho". A little later when I turned it back on I caught her disrespecting the Bush twins by saying they are wearing hello kitty t shirts and flip flops when they find them passed out on the White House lawn the next day. Humm....the word Ho and being disrespectful to intelligent, college educated young women, if MSNBC was so offended by Imus then Stephanie Miller should have been yanked off the air that morning. Haven't heard anyone mention her comments.Did anyone else catch her comments? Shows Imus wasn't fired by his words but by giving an opening to Al Sharpton to stir up the troops, Imus was too rich and too powerful, and spoke the truth so the Sharpton bunch had to get him off the air.
Imus was fired because certain person(s) running for president wanted him off the air. The strings were being pulled by powerful people behind the scenes and MSNBC and CBS were either in on the concept or they ineptly allowed themselves to be manipulated. I hope Imus enjoys his 40 million.
I miss Imus in the morning and look forward to having him return. The testing of other morning hosts on MSNBC has not come close to the intimate interviews, knowledge gained and fun of Imus. This experiencve will make him a better person, I believe he can be enjoyable without the harshness.
IMUS was the best and the ONLY thing worth watching on TV. His firing is a sham. Jackson and Sharpton are bigots. I'd love to see them apologise to the Duke LaCrosse players whose lives were ruined by their grandstanding in the trumped up alleged rape case. The day 50 Cent is taken off air by CBS and other radio stations cannot come soon enough. But it never will because 50 Cent generates revenue. With Imus off there air there is a real void that cannot be filled. His satire at times was brillant the positive things his show did for vetrans was terrific can the spinlest ex @ CBS & NBC do the same i don't think so. Imus we miss you.
Regardless of your opinion of Jackson or Sharpton they have been taking rappers to task for years about the use of derogatory language and behavior. It just never gets media attention outside of the African American community. Truth be told almost all recording media is owned outside of this community and he who holds the money has the power and controls the message. Many rappers with positive approaches don't get the notoriety and air play that the gangsta rappers get (Common is a shinig example of this). When Jesse or Al don't get involved in a issue they are ostricized, when they do they are ostricized. If your perception of what campaigns that Jesse and Al are involved in leads you to believe they are racist, then I would encourage you to research all of what they do and rethink your opinion. Apply the same logic to them as you ascribe Imus. Although Imus had a history of inflammatory comments, his supporters encourage us to look at his entire career. I would encourage critics of these activists to review the total sum of thier work before passing judgement and applying labels to them. African Americans for years have fought against use of the language in hip hop. The generations today have changed the meaning of these hateful words and made them okay because thier use have become commonplace. Conservatives constantly complain about the liberal media and how one sided it is. Media just does not mean TV. If record executives only market the negative and since entertainment dictates what is acceptable in society then it is reasonable to assume that the media is the blame for the acceptance of the deragatory terms. The media controls the access to the differences of opinion. Just a thought!
SCORE Al Sharpton & Jesse Jackson: 1 10,000,000 Imus fans for 30 years: 0 It would have been nice if CBS and MSNBC execs thought that listening to their customers was as important as listening to two whining opportunists. The Rutgers basketball team showed total class in accepting Imus's apology. The network execs showed total lameness in pulling one of their best shows because Sharpton and Jackson saw a chance for network face time and trumped up outrage. I looked forward to Imus's show every morning and haven't listened to the stations who dropped him like a hot potato since. Or bought products from any of the advertisers who ignored all the good he has done over the years. They forgot about me, their customer and listener. I won't forget what they did. It was also very disappointing how few of Imus's guests came to his defense. I applaud Bill Maher, James Carville, Joe Scarborough, and Pat Buchanan for keeping things in perspective. Shame on the many others who were so quick to use Imus's show to promote their own books and careers over the years, but were hiding in the closet when he needed you.
The firing is so stupid. Why don't the blondes rise up and sue everybody for all of the colorful jokes and comments said out them.
So let's condense the Imus fan's/conservative white males arguments for the sake of brevity... Al Sharpton/Jesse Jackson! Rappers! Freedom of speech (for white guys)! Also, in other news, two wrongs apparently DO make a right and apples are identical to oranges. Funny how Jim Zumbo had the heavens fall on him with nary a peep (for the most part) conservatives when he slurred a subset of gun owners, even after he begged forgiveness; Imus utters a slur against a specific bunch of young women (not say, a misogenistic, yet generic slur a la average MTV rapper) and he was just joking, and his bosses were cowards, and it's the pivotal Free Speech moment of our time. Hypocrites.
MSNBC TV is a vast wasteland without the I-MAN. Can't watch it, won't watch it. Until Imus is back, sign me Lost in the morning
What's happened to the 45 people employed by Mr. Imus?Did MSNBC find jobs for those unemployed by his firing? We are hoping the lawsuit wins and teaches a lesson to the media. The contract you sign is binding!!
