Imus sues CBS

Don Imus was all apologies when the fire was raining down on him for calling the Rutgers'  women's basketball team names. But he's not taking his firing sitting down, according to Fortune.com. They report that the DJ plans to sue CBS radio for the $40 million remaining on his contract.

At first, the alleged suit seems laughable. Imus messed up, he got fired, and now he wants his big paycheck for doing nothing. But nothing is that simple. A source tells Fortune that Imus' contract urged him to be "confrontational and irreverent," and that he was promised a warning before he was fired. I'm no contract lawyer, but if that, especially the last bit, is really in Imus' contract, he may have a case.

It could get really interesting from here on out, however, if the suit does come to pass. Imagine suited up lawyers trying to define "confrontational and irreverent." I would think that CBS's side of things would be that it's one thing to be irreverent about public figures, another thing to use a tasteless racial slur against college women who've never asked to be in the public eye in quite the same way.

The "warning" language, if it exists, is more interesting. Did CBS really put that in Imus' contract? Had they thought that through? If the DJ did something severe enough to rate a warning, couldn't CBS have foreseen that a public outcry akin to the Rutgers situation would erupt? High-priced lawyers on both sides must be licking their chops at the prospect of delving into the actual contract language because if it's at all as Fortune represents, there could be a million loopholes on either side of the fence. If anyone thought Imus' firing meant his name would stay out of the news for a time, stay tuned. It looks like things are just heating up.

Predjudice cannot see the things that are because it is always looking for things that aren't. Imus needs to be back on MSNBC, it was the only really great format they had. You,NBC & CBS, have lost many listeners.
Don Imus pissed me off on more than one morning but I kept watching because he never pulled punches with anyone he had in his sights. Don Imus put his money where his mouth was. I can't point to a single person in the media who has done even 1/2 of what Don and his wife have contributed to this country both financially and in pushing issues that REALLY MATTER. I can't wait till he is back on the air. MSNBC is spineless but now they will pay with the collapse of their entire network. Don Imus was the only thing worth watching on that network.
Imus was wronged. He made the equivalent of a minor traffic violation and was given the death penalty. I quit watching MSNBC the day he was no longer on. I listen to NPR but no longer start the day with a laugfh or hear a controversial interview. Sue the pants off of CBS and get back on the airways! The quicker the better!
Imus brutally attacked all his sportcasters personally giving no respect to them,& same way with the show's working ladies.He was too arragont & cruel unnecessarily continually to so many.He was two-faced about most guests. It was not funny to see/hear such meaness to so many. He bragged about his money so why does he need more. His sponsors waited too long to dump him & his vulgarity. MSNBC has unclean hands too. It does not take filthy language to be funny commedians & to have a hard hitting show.Loss of money may help to redeem all the Imus'that are so mean to others & think its funny. Hopefully, we ALL must rise above the the Rev.Jackson & Sharptons'biased thinking & ways and IGNORE THEM.

Sumner Redstone (head of CBS corporation, owner of CBS Radio) must be a happy man today. Maybe when he said that Les Moonves (the president of CBS Radio) would do the right thing about Imus, he meant that Moonves would have a spine and stand behind Imus and protect CBS stockholders. I truly miss Imus and I've listened to him for over 30 years. The example he's shown us through the years -- from his overcoming his personal demons to his transformation to an interviewer who gets politicians to actually answer questions to his sincere apologies to the Rutgers basketball team is the most public illustration of being a stand-up person -- take full responsibility for your actions and make amends to those you've harmed. Too bad for us, the executives at CBS learned nothing from Imus.

Seems like the big guys forgot who really are their customers, advertisers don't go away for long when there is a buying audince. I know you will come back bigger than ever.
Bring back Imus!!! I hate my drive to work now. I went out and bought XM so hopefully Imus will go there. I'm a bleeding heart liberal Hillary supporter, often didn't agree with Imus but thought he was often funny and thought provoking, and he had great guests who spoke to him in ways they don't speak on other news shows. Imus dissed everyone; still he went over the line this time, but he knew it and APOLOGIZED to everyone and everybody, including the team, who accepted his apology. This was a basically good guy who made a mistake. He does all sorts of great things for kids. Whatever spineless executive who made the decision to fire him didn't look beyond their nose. This took race relations back to OJ. What about forgiveness?
This is not a Free Speech issue folks. The company had the right to fire him, they are not the government. Had the government said to fire him, different story. Think about it, at your job, if you say something management does not like, you can be fired. The show was not going to be profitable since the advertiser left. It is simply a matter of economics. Yes, the outcry made them do it, no doubt, but the goverment did not censor him. His company fired him because he was not going to be able to make them money, which was his job basically
What Don Imus said was a "figure of speech", not a deeply held belief.Just remember who plays the "I Have A Dream Speech" on Martin Luther Kings birthday.Just remember who helps kids with cancer,and many other causes. Don Imus is a good man and a decent human being.Can't we remember him for that.

Imus had not only one of the best news programs in America, but was also very entertaining. Firing him for his inappropriate remarks, was a very radical response by network execs. Imus crawled in the mud to appease Al Sharpton who has done more to erode race relations then anyone in history. Imus had command of a significant platform and opportunity to be the spokesman for improving race relations, as he has done with many other important social issues. Unfortunately he was silenced by MSNBC & CBS execs that did not have the ability to see the positive aspects of a national dialog on race relations. The talented young ladies of the Rutgers basketball team had their say and determined it to be appropriate to accept Imus's apology. Since the Imus firing fury died out after one week and is now forgotten, are the Rev. Jackson, you know, the one with the illegitimate child, or Al Sharpton, videotaped by the FBI agents making a cocaine deal, working to lift black America? Or are they making a big living from the predicament of the less privileged of our country that continue to struggle for equality. It's time for our black brothers and sisters to seek leaders that have credibility with all Americans. Did Imus do wrong? Of course he did. As a long time follower, I know that he is a very good person that has been a victim of corporate America's obsession to be politically correct, even if it offends the majority.
Ed is right: there is no free speech issue in any of this. That's that. I watched Imus every morning that I could (when I wasn't traveling) for ten years, on MSNBC. I think he's about half a moron. He was the best interviewer and no smiley-faced nonsense thing going in that end of the show-biz spectrum, by far, and now it's just gray every morning. CBS & MSNBC: youse guise are fools. Historic. If the details of the contract are as initially buzzed about, and there's a real case, then I hope Imus skins you alive.
we have not wached MSNBC. since you fired don i. we are very disapointed in whay they handeld his blunder. cowtowing to hypocrits like rev. sharpton and jackson has shone MSNBCs true colors. I hope i am called to be on jury for his rightfull lawsuit.
I had listend to Imus regularly for about 10 years. On many occasions over that time I wondered how those on the show (not just Imus) got away with some of the things said. I guess I may now have the answer - Imus' contract apparently required it. And, if that's the case, Imus should sue the hell out of CBS. He'll probably use a portion of the payout for charitable purposes any way. Radio has lost, for the present, one of its best entertainers (afterall, who else besides Imus would have the guts to ask then 2004 presidential candidate John Edwards, "what's that thing on your lip?") as well as true example of someone willing to face their own issues and accept personal responsibility for their past and present actions whether it be urinating in a phone booth or offending someone. CBS' firing of Imus did nothing to redress the alleged issue (racism). His firing does not "take back" the comments - Imus' apology to those offended is/was the only thing that could come close to doing that. For that matter, it's entirely possible the women of the Rutgers basketball team would never have even known about the comment and would have felt no ill effects whatsoever had it not been for the opportunistic actions of Mssrs Sharpton and Jackson. I have a sneaky feeling the young ladies don't fit the Imus in the Morning audience demographic. Nice job Reverends.
For all those claiming that Imus was fired because advertizers pulled their spots- do you really think that's what his contract said? And when did advertizers, who make billions by pimping products you don't need, become shining examples of morality? Sheesh. These multinational corporations have spines like wet noodles and they folded because they think the tide only goes one way. They didn't realize that millions of fans would be upset long after the villagers with pitchforks had gone after another target. I wasn't planning on buying a Chevy but I sure as heck won't be buying any P&G products, Bigelow tea, or anything at Staples. I'm still mad and now I'm looking at labels! Imus was the best thing on morning TV and radio. Everyone else is a partisan hack or a cue card reading clone.
CBS deserved to get sued, they fired Imus without any justification what-so-ever. CBS explicitly wanted Imus to engage in the kind of radio he engaged in, but when the heat got turned up, weak kneed Leslie Moonves tucked his tail between his legs and fired Imus. Cbs can't have it both ways. CBS has tried the same crap with Howard Stern and Stern sent Moonves home crying...Imus will do the same, and he will pocket 40 million to boot.
Hey I have an idea; since you've tried every other loser and blowhard to replace Imus why not give Al Sharfton a shot? All one has to do to know that Imus is anything but a racist is just listen to his show. Sharfton is a bigger racist and done more to harm racial relations in this country than Don Imus ever will. Nice call on losing the best morning host and one of the best interviews in history.
Wonder what Imus' former guest Sug Knight thinks of all this. Anyone who has watched the Iman knows he should have never been fired. I hope Imus knows that he has millions of listeners behind him.
I bet all the White Supremists gave a big sigh of relief when the Al Sharpton gang got MSNBC to decide to not bring Imus back, IMAGINE if after a suspension Imus came back all the good he could have done regarding racial tensions. The first thing he probably would have done was to have the Rutgers girls on for a week or so to have an in depth conversation, then all the others who he could have addressed this with, in his thoughtful and insightful way of interviewing,the educating and understanding by both Imus and the rest of us that could have come about with this rare chance is undeniable. But then, MSNBC doesn't care about that, they were just scared of Sharpton and Jackson. The one person who actually made some sense was a black writer named Jason Whitlock from Kansas City I believe, who said Imus should not have been fired as blacks keep doing it to themselves, that a powerful white man should not be able to make those girls feel less of themselves. He also called Sharpton and Jackson "professional pick pockets". Too bad the majority of the black community can't see the reality as Jason Whitlock does, that is why I said White Supremists are relieved there won't be any in depth conversations on this, it makes their job easier!
I here Imus may be back on Radio sometime in Sept. I can't wait. There is nothing on the radio in the morning worth listening to. I guess the sponsors think advertizing on a radio that no one is listening to is better than advertizing with Imus. I bet they are kicking themselves now.
As far as I can tell, here is what has happened since this incident began: 1. The Rutger's players have not been scarred for life. 2. Sharpton and Jackson have disappeared into whatever mousehole they usually disappear. 3. Al Roker's smile can no longer hide his racial bias. 4. I cannot watch Imus in the morning. Free speech occurs when all parties are allowed to speak. To silence one party because they offend another (or others) is not an exercise in free speech; it is the implementation of an insidious censorship not-so-cleverly disguised as free speech.
MSNBC & CBS - I can't believe you've allowed just a few! of the “Cry Baby Citizens” in these United States of America, to put a price tag on My/Our Freedom of choice. They had the right of choice to turn The I-man off if they didn’t like what he said. Now that he’s gone I/We no longer have a right of choice. That’s just not fair to the rest of us “the silent majority”. You should be ashamed to even call yourselves Americans, One of the Caretakers of our right of free choice. The right to hear someone with a different point of view. By firing IMUS you have allowed those that don’t believe in Freedom, to yet further erode our American way of life. I listened to and watched Don Imus for a few years and then had the opportunity to meet him when he came to town for an appearance. He was totally arrogant and had a "holier than thou" attitude. Maybe this firing and the lack of his "friends" standing behind him will show him he's not all he thinks he is!
I hope Imus goes through with his lawsuit and I hope he wins BIG TIME!!! When he is through with CBS and MSNBC, I would love to see him go after Sharpton & Jackson - these two are the biggest racist/biggots in the entire country - probably the world! Imus should never have been fired. I agree that maybe his comments were in bad taste, but the ladies from Rutgers were classy enough to accept his apology (which was extremely sincere) and that should have been the end of it. This country would be far better off if we got rid of the Sharptons and Jacksons of the world. I hope Imus comes back to the airwaves soon as my mornings are awful without him and his crew. MSNBC - smarten up and get rid of that garbage you put on in Imus' place!!
A message to MSNBC and CBS: Don''t you think that a man who had the intestinal fortitude to cure himself of drug abuse, and who experienced this career / life changing tsunami would have been both capable and MOTIVATED to launch the national dialogue about racism and sexism that this country so desperately needs? The I Man would have stepped up to the plate! So now that he's been silenced, can we expect those sterling watchdogs of virtue, Al and Jesse to do the same?
If his contact has a "One Warning" clause then CBS should just pay him the 40 million now. I watched him daily, I disliked the racial and ethnic jokes but loved the chance to hear reporters talk for 5 minutes instead of 30 or 45 seconds on matters of substance. Imus is a great interviewer, the I-man persona ended leading to his broadcasting demise. Whoever signed off on Imus' contract at CBS is toast.
There is nothing on TV in the morning now that I-Man is gone. I am a liberal pro-Hillary DEM. I tried to get used to David Gregory filling in the 5:30 am to 9:00 am slot and even he didn't seem right without Imus teasing him about his dancing. It was a little unseemly for David to be there in his former frien'd timeslot. The Philly cone-head was soooo bad I could hardly stand it. Every other phrase he uttered was X "relative to" Y. And Stephanie Miller? Egad. I share most of her politics, but she was just vile. Those over-used, sophmoric sound effects on her show made the Imus show production seem downright sophisticated. (It really was, you know.) Imus played great, interesting music -- I'll never forget how he played the Dixie Chicks at EVERY break during their comeback. They need to send at least one of their five Grammy awards to him. Imus even touted the generosity of Rosie O'Donnell and her personal $300,000 donation to the Intrepid Heroes Fund. You never heard Donald Trump dissing her on the Imus show . It would have been a great healing and learning experience for everyone if Imus had been allowed to continue his show -- with a new perspective on race relations and gender equity. We have lost an opportunity and a platform for national dialog on these important issues and all the other important causes that Imus championed.
I miss Imus in the morning. I refuse to watch msnbc because of msnbc' overreation,in firing him, and non acceptance of his profuse apology. Imus has worked to bring many causes to the forefront of the news -including the Walter Reed scandel and he has also worked for health issues like Autism and Kids with Cancer. He is a good admirable person, that I hope will come back on the airwaves. Good for Imus! I hope he not only sues CCS,, but also msnbc and wins both.
I listened to him for 20 years. If he didn't get fired for the Maya Angelou impersonation then he should never have gotten fired for this. just a couple of panty-waste suits who didn't stand up for their own right to present an entertaining person. Forget the law suit, just bring Don Imus back where he belongs. He shouldn't have been fired in the first place! I along with others miss, Imus a lot. He should get his job back. Hopefully, this is the reason he's suing and I'm almost certain that it is. Then things can go back to the way they were. Also, NO changes should be inflicted on him either. Any one who listened to Imus knew what he was all about. I use to watch every morning faithfully, If I didn't agree that particular day , I would simply change the channel.There is a void that just cannot be filled.Boy my mornings are LAME now..Bring back the I MAN....Dont his fans have a say??????
I've said it before, and I'll say it again: political correctness is killing the world. When did we acquire a constitutional right to go through our day without being offended? Guess it steamrolled free speech somewhere along the way. What is this teaching our kids? That if someone hurts their widdle feelings with a stupid and ill-planned remark they can call the media moguls and the whole thing will end in a debacle of lawsuits? Sooner or later, we're all going to have to stop talking, emailing, and blogging for fear of offending someone. Oh better axe art too...that's been controversial for years. And literature. And music. I support Imus. I dont think that he made a racist comment. We all know now that most of the players were black, but how is what he said racist? The issue is whether there was harm done. Yes, when you are publicly called out a ho, there is damage. All your friends, family and fellow students can see it on tv even if you don't, and you will hear about it. He is guilty of character defamation. We all know white people must NEVER suffer the consequences of their actions, especially when it comes to blacks. However, the young ladies should sue both Imus and CBS as well. They were the true victims, not Imus.
I was sitting in the Charlotte airport when I saw that MSNBC had just fired Imus and immediately sent emails to everyone at MSNBC that I would no longer watch their hideous network without Imus. I also informed them that I will no longer buy products that pulled advertising. I miss Imus and wish he would come back, but it will never be the same if he did.
This is a deal. Imus did nothing wrong,Besides speak his mind and thats his job, if you dont like it turn it off. I turn of rap music because I dont like it, for what they say. As a short, slightly chubby senior lady with a definite Southern accent, I could have taken unbrage with many remarks made by Imus and the crew over time, but I understand humor and talk entertainment formatting. MSNBC should give up trying to fill Don Imus' shoes...no one is watching.
MSNBC and NBC are hipocrites. They dump IMUS because of his hurtful comments to young women...then day in and out they air Alex Bladwin calling his daughter a pig. Guess the "30 Rock" star gets a pass for hurting his daughter in front of the country and they have no problem with airing it day and night? Sharpton is a racial bigot. Just look at the clear and direct attack on Mitt Romney.Then -watch him deny he said it. If you see any Christianity in Sharpton's comments or actions-please adivse.He is a racist. I am an African American woman who has watched Imus on a regular basis. Imus is NOT the racist that everyone is making him out to be. When he apologized, I knew he was being REAL. Most of the people who pounced on him had NOT even seen his show. I am so disappointed that BOTH MSNBC and CBS dumped him so quickly. I can't blame Sharpton and Jackson entirely for his firing, but they were a HUGE part of it. Ironically, Viacom who owns CBS was willing to pay Dave Chappelle $50 MILLION DOLLARS to make racist jokes, dumped Imus when he uttered those three words. Ironically, NBC begs Alec Baldwin to stay on 30 after he berates his daughter on national tv. Last but NOT least, Al Sharton places his foot squarely in his mouth and the media BARELY blinks! What HYPOCRITES!
A question to MSNBC and CBS: Can you define the words cowardice, hypocrite and spineless? For such a supposedly intelligent group of individuals, I am astonished at the collective lack of backbone in standing up to the Rev.(using that term loosely)Al Sharpton. Imus is/was the best thing on morning radio as well as T.V. and the show is admittedly edgy and always pushing the envelope yet it is embarrassing that you caved in to the threats of Mr. Sharpton, or as I like to call him "Mr. Double Standard". Could you please do some intensive research into the "RACIST" comments made by the Rev. and at least admit that he, the hypocrit, led you execs. right where he wanted you. Shame on you!!!! I am no longer watching MSNBC because of what was done to Don Imus. Imus in the Morning was the best show ever and when he was removed from the air, that was the "Day the Music Died." I am deeply hurt and extremely furious over the double standard here and also the blatant hypocrisy. I totally support Don Imus and will always be loyal to him. Goodbye MSNBC.

I have watched the I-man for 3 years. He is everything I stand for, Nascar, country music and a great sense of humor. I was never offended by his comments, because, I took them as humor. Rev. Al Sharpton (where did he go to college degree from in theology) who is a bigot along with the other bigot Rev. Jesse Jackson. They are the most outrageous two human people I ever listened to. Everything that comes out of their mouth is absolutely nonsense. Why do people back down to these two hypocrits. It seems that MSNBC & CBS is scared of them. We need to stand up to people like this that seems to have such a strong control over America. I will never watch MSNBC or CBS ever again, unless they bring Don Imus back.
I agree - no more MSNBC for me. They are cowards and hypocrites; they hired Imus as a shock jock and when he acted like one they panicked and canned him. I keep hearing rumors of Imus being back in October; if he is, and I have to pay for it (Sirius) I will. Imus is worth the money; MSNBC isn't.
I"m just waiting on the I-Man to return somewhere! The morning shows on MSNBC have been AWFUL !!!!!!! Imus in the Morning listerners were NEVER considered in this decision. I try to watch in the mornings, but usually turn it off in about 5 minutes! Disgusted and VERY DISAPPOINTED in MSNBC!
I liked your Imus show and didn't think you could get a better replacement until I watched Stephanie Miller. She was bright , funny and entertaining I hope you don't let slip through your fingers as she tops Imus.
